Update to the Global MLS Purchase Contract
As of November 6, 2023, the Global MLS will provide a new Purchase Contract for your transactions. We currently offer three documents in both Global MLS and Zipforms. They will be replaced with the new “Global MLS Purchase/Sales Contract 8-23.” To avoid confusion, other versions will be removed from the library. However, you are always free to use any contract format you prefer.
Update to the Global MLS Rules and Regulations Clear Cooperation Policy
CCP has been a required NAR MLS policy across the country since 2020. Simply stated, if you publicly market a listing in the GMLS Service area, it must be in the GMLS within one business day.
Violation of the CCP creates a significant amount of market disruption and adversely impacts buyers and GMLS members. As GMLS members have experienced excessive CCP violations, the GMLS Directors determined that sanctions surrounding CCP violations required adjustment.
The revised policy took effect September 1, 2023. Current applicable consequences for violating the CCP appear below:
Section 2 – Clear Cooperation
- Within one (1) business day of marketing a property to the public, the listing broker must submit the listing to the MLS for cooperation with other MLS participants. Public marketing includes, but is not limited to, flyers displayed in windows, yard signs, digital marketing on public facing websites, brokerage website displays (including IDX and VOW), digital communication marketing (email blasts), multi-brokerage listing sharing networks, and applications available to the general public.
- Exclusive listing information for required property types must be filed and distributed to other MLS Participants for cooperation under the Clear Cooperation Policy. This applies to listings filed under Section 2 and listings exempt from distribution under Section 2.16 of these Rules and Regulations, and any other situation where the listing broker is publicly marketing an exclusive listing that is required to be filed with the service and is not currently available to other MLS Participants.
Effective September 1, 2023, a violation of the Clear Cooperation Policy will result in:
- Initial Fine: $1500
- 2nd Violation: $3000
- 3rd Violation: Suspension (not to exceed 90 days)
Please be aware that there are many rules that apply to entering listings in the Global MLS, CCP is about the public marketing of a listing.
